Terms of Service

The following constitute the terms and conditions to which applicants agree when booking any Marine Guide Training (Seasmoke Whale Watching Inc) course(s) (Terms and Conditions). MGT reserves the right to review and update these terms periodically.

By booking with us, you agree to these Terms and Conditions, so please read carefully.

1. Definitions

1.1. “MGT” means Marine Guide Training.

1.2. “Course” means any course or assessment facilitated by MGT either in-person or online.

1.3. “Participant” means the individual or entity that has purchased the course. “Participant” also refers to any individual taking the course purchased by their employer or outside entity.

1.4. “Training Materials” refers to any printed or digital documents, provided either in-person or online by MGT in relation to the course.

2. Registration and Booking

2.1. A registration form must be filled out by the participant. Following submission of the registration form, MGT will contact you to confirm details and a provisional booking will be made. A $300 non-refundable deposit is required to hold your booking. Full payment is due 60 days prior to the start date of your course unless otherwise stated on your invoice. Partial payments prior to payment due date are accepted.

2.2. Payment is made online.

2.3. Participant agrees that the information provided in the registration form is correct.

2.4. When deposit and payments are made, participants will receive confirmation emails and receipts for payment.

2.5. We take all necessary steps to ensure any information you provide for booking and payment is kept private and secure.

3. Cancellation

3.1. 60 days or more before the course: full refund minus CAN $300 deposit.

3.2. 31 to 59 days before the course: 50% of the course fee. This includes bookings made 31 to 59 days before the course.

3.3. Within 30 days of the course: no refund, including bookings made within 30 days of the course.

3.4. In the event of cancellation by MGT, a full refund will be issued or participants may transfer the payment to a future course, subject to availability. MGT is not responsible for reimbursing participants any other costs including, but not limited to travel costs, insurance fees, or equipment purchases required for the course.

3.5. MGT reserves the right to cancel a course for any reason, including, but not limited to: insufficient enrollment, inability of instructors to facilitate training, or force majeure.

4. Limitation of Liability

4.1. Participation in activities during the course involves inherent risks. MGT is not liable for personal injuries, death, or property damage incurred during the course.

4.2. Participants will be required to sign a Limitation of Liability document in order to participate in the course. This will be provided once the registration form is received by MGT and payment of deposit is made.

5. Travel Insurance

5.1. MGT requires participants to purchase travel insurance covering trip cancellation (recommend “cancel for any reason” policies), including medical coverage and repatriation if traveling from outside of Canada. Please ensure the policy includes coverage for driving and being a passenger in a small boat.

6. Participant Requirements

6.1. Participants must be physically fit and able to participate in all components of the course. Driving a Zodiac, hiking, catching boats, assisting passengers, performing rescues, etc are physically demanding. Expect to be outside in changing weather conditions, including heavy rain and wind.

6.2. We expect 100% attendance to all course activities. Failure to attend 100% of the course may result in withholding of course completion certificate or inability to provide assessments.

6.3. Participants are required to: use course materials and equipment with care and diligence; comply with rules of conduct and professionalism in regards to health, safety, and accident prevention; follow any reasonable instructions from course instructors.

6.4. MGT reserves the right to remove any participant from the course at any time if they are (i) deemed unsuitable or unfit to participate in the course or (ii) if the behaviour of the participant is deemed unsafe, offensive, or would otherwise inhibit facilitation of the course or learning of other participants.

7. Changes to the Course

7.1. MGT reserves the right to alter the training schedule, substitute instructor(s), or update course materials.

8. Training Materials

8.1. Any training materials provided by MGT are protected by copyright and may not be reproduced, shared, or used for any other purpose than that of the course for which they were received without prior written permission by MGT.

9. Governing Law

9.1. These terms are governed in accordance with the laws of Canada.

10. Acceptance of Terms

10.1. By booking a course with MGT, participants agree to these Terms and Conditions.
